In New York State, a person that has a sexually transmitted disease has a legal duty to disclose it to his or her partner prior to sexual contact. New York Public Health Law §2307 provides that "[a]ny person who, knowing himself or herself to be infected with an infectious venereal disease, has sexual intercourse with another shall be guilty of a misdemeanor." It is a crime! In addition, a victim can sue for significant money damages.
