New York Labor Laws and Employment Wage and Hour Information

We all deserve to be fairly compensated for the work we do. Wage and hour claims are governed by the Fair Labor Standards Act and the New York Labor Law. These New York labor laws set a statutory minimum wage and provide that overtime pay be issued to many employees who work more than 40 hours in a week or over 10 hours a day.

Even though your employer pays you a set “salary” you might still be entitled to overtime pay and spread of hours pay. Under federal and state laws, only certain job descriptions are exempt from overtime regulations. In fact, most employees are entitled to payment at a rate of 1.5 times their regular rate for every hour worked in excess of 40 during a workweek. Often, employers fail to adequately compensate their employees for this time.

In addition, most employees are entitled to a minimum hourly rate of pay. Currently in New York State the minimum wage is set at $7.25 per hour. Again, as with overtime laws, only certain job descriptions are exempted from federal and state overtime regulations.
